Privacy notice applicants

This privacy notice is applicable to the processing of personal data of applicants that apply for vacancies with Just Eat Just Eat is responsible for the processing of this personal data and highly values your privacy. Therefore, Just Eat complies with the General Data Protection Regulation with respect to the processing of personal data.

What and why we process personal data

Just Eat processes personal data about you because you have applied for an open vacancy with Just Eat We only process this data for the selection process and hopefully to welcome you in the future as an employee of Just Eat The legal ground for this processing is that we consider your application as a request to take steps prior to entering into a contract (employment agreement) in accordance with the GDPR.

We process personal data that you provide to us via the website, the application form, sent resumés or by other means during the application process. We process the following data as part of your application for a vacancy at Just Eat

  • identification data, for example, your name, photograph, gender, date of birth;
  • contact details, for example, your home address, personal telephone numbers and email addresses, emergency and/or next of kin contact details;
  • information on professional qualifications, previous employment, achievements and/or skills, for example, information comprising or contained in CV/resume, application forms and/or reference requests (and responses). This may also include any authorisations required in respect of your work, for example, evidence that you hold a particular category of driving licence. Some information in relation to references may be provided by third parties;
  • national or other identification documents, for example, your national ID/passport, “right to work” details, details of any visa applications, driver’s licence, ID/security number and national insurance number (or equivalent) and supporting documents where relevant and permitted by local law (e.g. utility bill, bank statement, birth certificate etc.);
  • spouse or partner and dependents’ information, for example, names, ages and contact details;
  • information relating to your previous employers; and
  • assessment data (if applicable)
Sharing with others

We work with other companies within the Just Eat group and other third party service providers, such as software providers and temporary agencies in order to carry out the processing described above. These group companies and service providers will process your personal data on behalf of us (as data processors) or as autonomous data controllers, and have access to your personal data for the purposes described in this privacy notice, and we require them to protect it in accordance with the standards set out in this privacy notice.

We will also share your data with other third party data controllers where appropriate or required by applicable law or regulation (including a court order) or where we believe disclosure is necessary to exercise, establish or defend legal rights or to protect the vital interests of any person. Such third party controllers may include law enforcement agencies.

We may also disclose your data to any company or prospective buyer of all or substantially all of our assets in connection with any sale or transfer of those assets.

Where your data gets sent

We may transfer your personal data outside of the European Economic Area. This may include transferring it to or accessing it from other jurisdictions that may not provide a level of protection equivalent to the EU data protection laws. Where we transfer personal data we will take account of any applicable statutory obligations relevant to personal data transfers and, where there isn't a European Commission (EC) adequacy decision in place, we will rely on appropriate safeguards, including EC approved standard contractual clauses. We have implemented similar appropriate safeguards with our third party service providers and further details can be provided upon request.

How long we keep your data

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal data so that it can no longer be associated with you, in which case we may use such information without further notice to you.

Therefore, your personal data is by standard retained for up to twelve months after your application process has ended.

Rights, questions or complaints

We inform you that, with regard to the personal data, you can exercise the rights provided for by the GDPR which include: the right to request access to, rectification of, or erasure of personal data or restriction of processing, and to object to processing, the right to data portability, to withdraw your consent at any time (without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal) as well as to lodge a complaint with a supervisory authority.

We may update this privacy notice from time to time in response to changing legal, technical or business developments. When we update our privacy notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Privacy Statement for Scoober App

This Privacy Statement applies to the processing of personal data of “Drivers” of Just Eat and affiliate companies. In order to have our Scoober delivery service function properly, we use certain of your personal data. We take your privacy seriously and, therefore, like to inform you about the manner in which we use your data, and for which purpose we use it. This Privacy Statement serves to provide you with this information regarding the personal data processed within the Scoober App, the way we process this personal data and the purposes of the processing.

What data is processed in the Scoober App

The moment you start your shift with us, you activate the Scoober App (hereinafter: “App”). This following data is processed within the Scoober app:

  • First and last name
  • E-Mail and Password
  • Start working and stop working timestamps
  • GPS location
  • Entered availability
  • Accepted open shift
  • Entered vacation leave
  • Open shift taken timestamp
  • Job seen timestamp
  • Job fetched timestamp
  • Job delivered timestamp
  • Geofence timestamps for pickup and delivery
  • Phone number
  • Analytics data
Why we process personal data
Planning and optimisation

Your GPS location is used for route planning and optimisation. This enables us to run our delivery service as effectively as possible and subsequently ensure that you only have to ride the shortest distance possible each time. Your GPS location is only processed during your active shift. As soon as you actively end your shift or start a pause (stop/pause button in the app) your GPS location will no longer be processed.

Food Tracker

Your GPS location, together with your first name, is relayed to the client and the restaurant for which you are delivering an order at that moment. We call this the Food Tracker. This Food Tracker enables restaurants and consumers to easily check the status of their order.

GPS Location

The App shares your GPS location with us during your shift for the purposes described above. You should be aware of the following:

  • Your GPS location is used for route planning/optimisation and, together with your first name, it is used to offer a Food Tracker to consumers and restaurants.
  • Your GPS location is relayed to Just Eat in multiple intervals per minute. Motion data, such as speed, kilometres travelled and so on, are registered in the App by default but will not be used by Just Eat
  • Your GPS location is only shared during an active shift, not during breaks or outside working hours.
App Analytics

Personal data that is processed within the app is also used by Just Eat for analytical purposes and to improve the app and delivery process of Just Eat

Performance improvement and evaluation (only applies to Just Eat drivers)

If you are an employee of Just Eat or working as a Driver but employed by a third party employer, will also use your data to improve the Driver performance on both a global and individual level. The following data is gained via the Scoober App for this purpose:

  • First and last name
  • GPS location
  • Orders delivered
  • Timestamps of order milestones (acceptance, pickup, dropoff)

The data gained through the Scoober App together with your employment data will be used for your individual performance evaluation. Your evaluation will always involve the judgement of the HUB- and/or City Coordinators and will never be based solely on the gained data or on automated decisions made based on this data.

Additional purposes

We will only use your data as described above. If we want to use the data for a different purpose, we will always ask you for your consent.

Sharing with others will not sell your personal data to third parties, and we will only disclose them to third parties if necessary for the performance of our contract with you, for analytical purposes, or to comply with legal obligations.

Whenever we instruct third-party companies to process your personal data on our behalf, we will enter into a data processing agreement to guarantee the same level of protection and confidentiality of your personal data. Just Eat will then continue to have ultimate responsibility for such processing operations.

Automated decision-making and profiling

For the purposes described above Just Eat may use automated decision-making and profiling. We for example use automated decision-making to select the orders that will cost you the least amount of time to deliver as a driver. These automated decisions are always under control of a natural person.

When such automated decision-making and/or profiling leads to a negative decision about you, and you do not agree with it, you can contact us on Privacy Form. We will then proceed to reassess the situation. We would aside from that also like to hear from you if you have suggestions on how to improve these processes.

How long we store personal data for will not store your personal data for longer than is strictly necessary for the purposes for which your personal data were collected. We will only store your personal data for longer if we are required by law to do so.

Use of consumers’ data

When delivering orders, you also receive data of the consumers. We would like to point out to you that the data of consumers, such as name, address and telephone number, may only be used to deliver the order. The use of this data for other purposes than the delivery of the order is prohibited by law and may lead to the termination of your employment contract.

Rights, questions or complaints

You have the right to access all personal data we collect about you, as well as to request that we rectify or erase your personal data. If you feel that we are processing your personal data without a valid legal basis or that we are processing personal data that are not relevant for our selection process, please contact us. You can contact Privacy Form. Just Eat will respond to your request as soon as possible, and in any case no later than four weeks after receiving your request.
